Ofelia Garcia Ortega was arrested Tuesday afternoon at the Salinas Superior Courthouse, turning a case that began with a dead newborn found along Struve Road in Monterey County into a second courthouse arrest tied to the same investigation. Monterey County sheriff’s detectives took the 36-year-old into custody at 2:45 p.m. without incident and later held her on $150,000 enhanced bail.
The arrest matters because the name Baby Angelita has now become shorthand for a widening criminal case. The infant was found dead Aug. 1 with signs of traumatic injury, and investigators have since said the 14-year-old girl at the center of the probe was abused and impregnated by her own father, Sergio Galvez Perez. Prosecutors say the girl is a victim of sexual assault by her biological father, and the case has drawn an Amber alert and cross-border law enforcement action after the father and daughter were found in Janos, in Chihuahua, Mexico.
For Ortega, Tuesday’s arrest adds new charges to a case that had already put her under scrutiny. The Monterey County district attorney’s office said investigators determined she put Jane Doe to work in agricultural fields at age 13 using falsified documentation. Prosecutors also said she allowed the girl to drive without a license and stay out of school for many months. Ortega was charged with two felony counts of displaying or possessing a forged identification card, one misdemeanor count of permitting a child to suffer or be endangered, and one misdemeanor count of contributing to the delinquency of a minor.
The court arrest also exposed a sharp break in the timeline. Ortega had already been arrested Aug. 4 on suspicion of child endangerment and was released after posting $50,000 bail. That earlier release did not end the case against her. Instead, detectives returned to the same investigation and took her into custody again Tuesday, this time at the courthouse, where she was already facing the legal consequences of the broader Baby Angelita inquiry.
The unanswered part is no longer what investigators think happened in the family. They have laid out the outline: a dead newborn, an abused teenager, a father charged Sept. 2 with lewd act upon a child, incest and child abuse, and a mother now accused of helping conceal the girl’s exploitation. Ortega is being held in the Monterey County Jail, and the girl is in the custody of a Mexican government agency responsible for child protection. What remains open is how much more of the family’s conduct prosecutors will turn into charges as the case moves forward.
