What Is Red Diesel? Trump Loosens Highway Use Rules Through Year-End

President Donald Trump signed an executive order in Nebraska on Monday that temporarily lets tax-free, dyed diesel be used on highways through the end of the year. The move changes how red diesel can be handled in road-registered vehicles and delays the federal diesel tax of 24.4¢ per gallon for on-road use until year-end, without interest or penalties.

That is why the search for what is red diesel suddenly matters. Trump said farm vehicles, construction equipment and other off-road vehicles have long used the fuel, which he described as the same as normal diesel but sold tax-free for off-road use and big trucks. He also said his order will officially waive the off-road requirement and allow anyone to buy tax-free red dye diesel for any reason.

The White House said the savings could be more than $100 per fill where states match the federal action. That figure matters because the order is not only about fuel use, but about whether the tax break reaches the pump in places that align with it. If states do not match the policy, the full savings will not follow in the same way.

There is still a sharp edge in the rule itself. Red dye diesel has been treated as tax-free off-road fuel, and burning it in road-registered vehicles has carried a minimum $1000 penalty. Trump’s order does not erase that history so much as suspend part of it for now: it allows the fuel on highways, defers the federal excise tax for the rest of the year, and says officials will explore ways to eliminate the obligation to pay those deferred taxes.

For drivers, truck operators and others who buy dyed diesel, the immediate effect is simple. The fuel that was built for off-road use can now move onto highways under a temporary federal waiver, but the lasting answer is still open. The order gives a year-end clock, and the next step is whether the deferred tax becomes something more permanent or fades when the calendar turns.
