has agreed to pay $2.25 million to settle a class action accusing it of charging multiple out-of-network fees for balance inquiries at ATMs inside 7-Eleven stores. The settlement covers accountholders who say they were hit with more than one fee during the same visit to an -owned ATM between May 1, 2018, and Nov. 16, 2021.

Under the deal, class members will receive a proportional share of the net settlement fund based on how many claims are filed, though no payment estimates are available yet. Plaintiffs in the case said they were charged two out-of-network fees for a single balance inquiry at 7-Eleven ATMs, and the lawsuit says that practice breached Bank of America’s contract with customers.

The settlement does not include an admission of wrongdoing by the bank. That matters because the deal resolves the claims without forcing the lender to concede the fee practice was improper, even as it puts money on the table for people who were charged more than one out-of-network balance inquiry fee during the same ATM visit.

A final approval hearing is set for Aug. 21, 2026.
